What is a notice of default?

A formal notice is a written communication in which you inform the other party that they are failing to meet an agreement. You give them a final reasonable period to comply after all. If the other party does not comply, they are in default (Article 6:82 of the Dutch Civil Code). From that moment you can take steps such as suspension, dissolution or damages. A formal notice is a private document; a synonym is a reminder or summons. In English this is called a notice of default.

Why a certified translation with a stamp?

If you use your formal notice in foreign proceedings or towards a party abroad, an ordinary translation is often not enough. A sworn translation is produced by a translator registered in the Dutch Register of Sworn Interpreters and Translators (Rbtv). The translator provides the translation with a stamp, signature and statement, which makes the text legally valid. This way your formal notice keeps its legal value in another language.
