What is a deed of sale and when do you need a certified translation?
A deed of sale (also called a sales agreement or purchase contract) sets out the arrangements between the buyer and seller of real estate. The deed is drawn up and executed by a notary, and is often connected with the deed of delivery and the mortgage deed. If you want to use these documents abroad or submit them to an authority that does not accept Dutch, a sworn translation is required. An ordinary translation is then not legally valid.
Why a sworn translation is legally valid
A sworn translation is produced by a translator registered in the Dutch Register of Sworn Interpreters and Translators (Rbtv). The translator attaches the translation to the source document and provides it with a stamp, a signature and a statement that the translation matches the original. This makes your translated deed of sale legally valid and accepted by official authorities. For use abroad, people often ask for an additional legalisation or apostille. An apostille is a statement from the court under the Apostille Convention (The Hague Convention, 1961).

The terms deed of saleand purchase contract are used interchangeably with sales agreement for the document that sets out the arrangements between the buyer and seller of real estate. When buying a house the deed of delivery and the mortgage deed are often involved too, and these can also be translated under oath.
Do I still need an apostille or legalisation after the translation?
