What is a title deed
A title deedalso known as proof of ownership, refers to the deed of transfer. This deed is drawn up by the civil-law notary and registered with the Land Registry (Kadaster). When the deed of transfer is registered with the Land Registry, ownership of, for example, a house passes to the new owner. A title deed is therefore different from the purchase agreement: the purchase agreement sets out the arrangements between buyer and seller, while the title deed arranges the legal transfer.
Why a sworn translation is needed
For use abroad, an ordinary translation of your title deed is often not enough. A sworn translation is produced by a translator registered in the Dutch Register of Sworn Interpreters and Translators (Rbtv). The translator adds a stamp, signature and statement, which makes the translation legally valid. This way the receiving authority knows that the translation is a correct representation of your original title deed.
In some cases, the foreign authority asks for an additional authentication. Then an apostille applies. An apostille is issued by the court under the Apostille Convention (The Hague Convention of 1961) and makes the translation usable in countries party to this convention. For countries outside the convention, legalisation is needed.
