What is a division deed?

A division deed is a notarial deed in which a building and the land that belongs to it are divided into separate apartment rights. The deed is drawn up by the notary and registered with the Land Registry (Kadaster). Among other things, the deed sets out which apartment right belongs to which owner and which rights and obligations apply. The division drawing is approved in advance by the Land Registry. For use abroad, a sworn translation of the division deed is needed.

Why a sworn translation?

A sworn translation is produced by a translator registered in the Dutch Register of Sworn Interpreters and Translators (Rbtv). The translator provides the translation with a stamp, signature and statement that makes the translation legally valid. Foreign institutions, notaries and authorities ask for a sworn translation because a regular translation is not accepted as an official document. If you want to use the deed abroad, you can also have the document fitted with an apostille. An apostille is issued by the court under the Apostille Convention (the Hague Convention of 1961).

What is a division deed?

A division deed is a notarial deed in which a building and the land that belongs to it are divided into apartment rights. The deed states how many apartments there are, how they are distributed across the building, which apartment belongs to whom and which rights and obligations you have as an owner.

How do I obtain my division deed?

You can have your division deed issued by the Land Registry (Kadaster), where the deed is registered. The deed was originally drawn up by the notary. For a sworn translation you upload a scan or photo of the document with your order.

Why do I need a sworn translation of my division deed?

Foreign institutions and authorities often accept only a sworn translationproduced by a translator registered in the Dutch Register of Sworn Interpreters and Translators and provided with a stamp, signature and statement that makes the translation legally valid.

Do I also need an apostille?
