What is a processor agreement?
A processor agreement is a contract between two parties under the GDPR (article 28). The agreement is mandatory as soon as an external party processes personal data solely on behalf of your organisation, for example a cloud service or software supplier. The agreement sets out arrangements about security, retention periods and the responsibilities of both parties. Unlike a deed or diploma, a processor agreement has no issuing government authority; it is a mutual contract signed by both parties.
Why a sworn translation?
A sworn translation is produced by a translator registered in the Dutch Register of Sworn Interpreters and Translators (Rbtv). The translator provides the translation with a stamp, signature and statement that makes the translation legally valid. This matters when you submit your processor agreement to a foreign partner, regulator or lawyer and need certainty about the accuracy of the text. For legal documents such as a DPA, an accurate and consistent translation of specialist terms is essential.

Frequently asked questions about translating a processor agreement
What does a processor agreement mean?
A processor handles personal data on behalf of another organisation and does not use this data for its own purposes. The GDPR (article 28, paragraph 3) requires that a processor agreement is put in place for this. Both parties are liable if such an agreement is missing.
When is a processor agreement mandatory?
A processor agreement is mandatory when one party processes personal data solely on behalf of the other. For equal parties that each have their own purpose and responsibility, a data exchange agreement is appropriate instead.
What is the difference between a verwerkersovereenkomst and a bewerkersovereenkomst?
It is the same document. Bewerkersovereenkomst is the old name for the agreement, which some authorities and companies still use. The current term under the GDPR is processor agreement.
Who is responsible for a processor agreement?
In practice, the controller often takes the initiative to draw up the agreement, because the initiative to outsource a processing activity also comes from that party. As the controller, you always remain responsible for the processing.
